# Immersive Simulations - Additional Product Terms

Effective from September 01, 2026

## **Go1 Immersive Simulations Product Terms**

These Go1 Immersive Simulations Product Terms govern the Customer's and its Users' access to and use of the Go1 Immersive Simulations Product. They supplement and form part of the Existing Agreement. Capitalized terms used but not defined here have the meaning given in the Go1 Customer Terms at [www.go1.com/terms/customer-terms](http://www.go1.com/terms/customer-terms). 

1. Definitions

1.1 AI Output means any response, dialogue, feedback, score, evaluation, recommendation, summary or other output generated by or through an Immersive Simulation.

1.2 Customer Content means any scenario instruction, prompt, script, document, policy, example, branding, data or other material submitted, uploaded, configured or made available by or on behalf of the Customer for use with an Immersive Simulation.

1.3 Existing Agreement means the agreement between Go1 and the Customer governing the Customer's access to and use of the Services, including any Order Form, statement of work, product terms and other documents incorporated into it.

1.4 Immersive Simulation means an interactive, AI-enabled learning activity made available through the Services as part of the Go1 Immersive Simulations Product, in which a User engages with an AI-generated or AI-operated character, avatar, scenario, conversation, prompt, assessment or feedback experience.

1.5 Simulation Data means User Inputs, AI Outputs, interaction metadata, scores, assessments, transcripts, audio recordings and other data generated through the use of an Immersive Simulation.

1.6 Third-Party AI Provider means a third-party provider of artificial intelligence, speech, transcription, hosting, safety, analytics or related technology used to provide an Immersive Simulation.

1.7 User Input means any text, speech, audio, selection, response or other information provided by a User in connection with an Immersive Simulation.

2\. Nature and limitations of Immersive Simulations

2.1 Immersive Simulations are technology-enabled learning tools that provide practice, feedback and reflection opportunities in simulated situations. They are not live instruction, human coaching, counselling, accredited assessment, or legal, medical, employment or other professional advice, and nothing in an Immersive Simulation or AI Output may be relied on as such.

2.2 Immersive Simulations use generative artificial intelligence and probabilistic models. Responses and outcomes may vary between sessions, including where the same or similar User Input is given.

2.3 AI Outputs are generated automatically and may be incomplete, inaccurate, inconsistent orunsuitable for a particular context. Go1 applies technical and operational controls designed to reduce harmful, biased or inappropriate outputs, but does not warrant that all such outputs will be prevented or detected. .

2.4 Any score, rubric result, proficiency indication or feedback generated by an Immersive Simulation is intended to support learning, reflection, coaching and capability development. It may be used by the Customer as one input into broader training, compliance, performance support or workforce development activities, provided the Customer does not treat it as a standalone or verified measure of competence, intent, personality, truthfulness, legal compliance or future performance..

2.5 Characters, situations and workplace scenarios in an Immersive Simulation are fictional or composite. Any resemblance to an actual person, organisation or event is coincidental, unless the Customer has intentionally configured the relevant materials.

2.6 Immersive Simulations are designed to support learning and may include references to legal, regulatory, policy or compliance requirements. Such references are provided for general learning purposes and may not reflect all jurisdictions, industry requirements, Customer policies or subsequent legal developments.

2.7 Immersive Simulations may be used as part of mandatory, regulated or jurisdiction-specific training programmes. The Customer is responsible for validating their suitability for its intended use and jurisdiction and for determining whether completion of an Immersive Simulation, alone or together with other training activities, satisfies its applicable legal or regulatory training requirements.

2.8 Go1 implements technical and operational measures designed to support responsible use and reduce harmful, inappropriate or biased AI Outputs, but does not guarantee that all such outputs will be prevented or detected. Customer customisations may not be subject to all of these measures, and the Customer is responsible for reviewing and validating its customisations before making them available to Users.

2.9 Go1 will display, within each Immersive Simulation, a notice that the User is interacting with an AI-generated character and not with a human. That notice addresses the fact of AI interaction only. It does not discharge the Customer's obligations under clause 3.2 to provide Users with the notices, policies, instructions and consents required for the Customer's own use of Immersive Simulations.

3\. Customer responsibilities

3.1 Suitability. Immersive Simulations are designed and reviewed using appropriate expertise and quality controls. The Customer remains responsible for their suitability for its use case and policies, applicable local laws, and its use of AI Outputs.

3.2 Notices and consents. The Customer must provide Users with all notices, policies, instructions and consents required for the Customer's use of Immersive Simulations, including in relation to recording, transcription, monitoring, assessment, privacy and employment-related use.

3.3 Not strictly as the message is generally embedded in the terms. This just reinforces the fact that Immersive Simulations or AI Output are not to be relied for the strict compliance purposes..

3.4 Validation before reliance. The Customer must independently review and validate AI Outputs before relying on them for any material purpose.

3.5 No high-stakes automated decisions. The Customer must not use, and must ensure that Users do not use, an Immersive Simulation or AI Output as the sole basis for a decision producing legal or similarly significant effects on an individual, including recruitment, promotion, dismissal, disciplinary action, compensation, or access to employment, credit, insurance, healthcare or essential services. Where an Immersive Simulation is used in connection with assessment, performance, compliance or workforce decisions, the Customer must ensure meaningful human review, contextual evaluation, appeal or challenge processes, and any legally required consultation or notice.

3.6 No official records. Unless otherwise agreed in writing, the Customer must not use Immersive Simulations to create or maintain an official employee record, investigation record, clinical record, legal file or regulated decision record.

3.7 No endorsement. The Customer must not represent that an Immersive Simulation or AI Output has been reviewed, approved or endorsed by Go1 as meeting the Customer's particular legal, regulatory, employment or compliance requirements.

3.8 Escalation and support pathways. The Customer is responsible for establishing, maintaining and communicating to its Users its own reporting, escalation, grievance and support pathways, including any employee assistance or crisis support services. Any Go1 safety, monitoring or review measures are intended to support product safety, security, quality and responsible use and do not replace the Customer’s own support pathways. Go1 does not undertake to identify, escalate or respond to individual disclosures, allegations, requests for help or indications of distress contained in User Inputs, transcripts or AI Outputs.

4\. Acceptable use

4.1 The Customer must ensure that Users use Immersive Simulations only for legitimate learning and development purposes and in accordance with the Existing Agreement, applicable laws and any product instructions issued by Go1.

4.2 The Customer must not, and must ensure that Users do not, use an Immersive Simulation to:

(a) generate, solicit or disseminate unlawful, fraudulent, deceptive, defamatory, harassing, hateful, discriminatory, sexually explicit or exploitative content, or content targeting or promoting harassment of or discrimination against any real person or group, except where that content forms part of an Immersive Simulation provided or approved by Go1 for legitimate training or assessment purposes;

(b) impersonate a real person without authority, create deceptive synthetic media, or misrepresent an AI interaction as a human interaction;

(c) attempt to extract system prompts, model weights, security controls, confidential information or personal data;

(d) circumvent safeguards, usage limits or access controls, or probe the Services for vulnerabilities;

(e) scrape or use the Services, personas or AI Outputs to train or develop an AI model, or to develop or benchmark a competing model or service, except to the extent this restriction is prohibited by law;

(f) publish or rely on an AI Output without appropriate human review, or make automated employment, eligibility or other high-impact decisions without meaningful human oversight;

(g) submit content the Customer is not authorised to use, or that infringes intellectual property, privacy, confidentiality or other rights; or

(h) engage in any other activity prohibited by the acceptable use provisions of the Existing Agreement.

4.3 The Customer is responsible for its Users' acts and omissions in connection with Immersive Simulations as if they were the Customer's own.

5\. Data, privacy and sensitive information

5.1 Where Applicable Data Protection Laws apply to data processed in connection with Immersive Simulations, the Go1 Data Processing Agreement (including Schedule 4 to it) applies and is incorporated into these Go1 Immersive Simulations Product Terms by reference.

5.2 The Customer must not submit, and must ensure that Users do not submit, special category data, sensitive personal information, confidential health information, government identifiers, payment card information, authentication credentials, or other information not reasonably necessary for the learning activity, unless Go1 has expressly agreed in writing to support it.

5.3 Voice input. Where a User uses voice functionality, voice input is processed for speech-to-text transcription and is not retained following transcription. Go1 does not create or store voiceprints, voice templates or other biometric data from voice input..

5.4 The Customer remains responsible for ensuring that its use of voice-enabled features, including any recording, transmission, transcription and analysis of audio, is lawful in each applicable jurisdiction, and for providing any notice and obtaining any consent required in connection with those features.

5.5 Where Go1 makes retention, deletion or access controls available for Simulation Data, the Customer is responsible for configuring them appropriately and for exporting or retaining any information it requires before expiry or deletion.

6\. Third-Party AI Providers

6.1 Go1 may use Third-Party AI Providers to provide or support Immersive Simulations. Those providers may process Simulation Data as sub-processors or service providers in accordance with the Go1 Data Processing Agreement.

6.2 The availability, performance and functionality of Immersive Simulations may depend on Third-Party AI Providers. Go1 may add, replace or remove a Third-Party AI Provider or underlying model where reasonably necessary to maintain, improve, secure or develop the Services, and will use commercially reasonable efforts to ensure that any such change does not materially reduce the overall functionality of the Immersive Simulations Product.

6.3 Go1 will not permit a Third-Party AI Provider to use identifiable Customer Content, User Inputs or Simulation Data to train a general purpose or publicly available model.

7\. Customer Content and intellectual property

7.1 The Customer grants Go1 and its sub-processors a non-exclusive, worldwide licence during the Term to host, copy, transmit, adapt, process, display and otherwise use Customer Content as necessary to provide, secure, support and improve the Immersive Simulations Product for the Customer.

7.2 The Customer warrants that it holds all rights, licences, notices and permissions required for Go1 to use Customer Content and User Inputs as contemplated by these Go1 Immersive Simulations Product Terms.

7.3 Go1 may reject or remove Customer Content that infringes third-party rights, contains unlawful or harmful material, creates a material security or safety risk, or is otherwise inconsistent with the Go1 Customer Terms.

7.4 As between the parties, Go1 and its licensors retain all rights in the Services, the Immersive Simulations Product, underlying models, software, prompts, templates, characters, avatars, rubrics, methodologies, interfaces and Go1-provided content. The Customer retains ownership of Customer Content, subject to the licence in clause 7.1.

7.5 Subject to Applicable Law and third-party rights, the Customer may use AI Outputs generated for it during the Term for its internal business purposes. Go1 makes no representation or warranty that AI Outputs are unique, protectable by intellectual property rights or non-infringing. Any intellectual property infringement indemnity or warranty in the Existing Agreement does not apply to AI Outputs, or to any claim arising from the Customer's or a User's use of AI Outputs.

8\. Product improvement and model training

8.1 Go1 may use aggregated and de-identified usage information derived from Immersive Simulations to operate, analyse, secure, support and improve the Services, provided that information does not identify the Customer or any User.

8.2 Go1 will not use identifiable Customer Content, User Inputs or Simulation Data to train any publicly available or third-party foundation model without the Customer’s prior written agreement. Go1 may use Simulation Data to develop, train, evaluate and improve Go1’s own models, prompts and services, subject to the applicable data protection term.

9\. Changes, beta features and availability

9.1 Go1 may update the Immersive Simulations Product, underlying models, prompts, characters, avatars, rubrics, interfaces and functionality from time to time. Updates may change the style, content, accuracy, latency or behaviour of AI Outputs.

9.2 Features identified as beta, preview, pilot, experimental or early access are provided for evaluation only, may be changed or withdrawn at any time, and may be subject to additional limitations notified by Go1.

10\. Disclaimers and allocation of risk

10.1 The Immersive Simulations Product and AI Outputs are provided on an "as is" and "as available" basis, except for any express commitment stated in these Go1 Immersive Simulations Product Terms.

10.2 To the maximum extent permitted by law, Go1 disclaims all warranties, representations and guarantees, express or implied, in relation to Immersive Simulations and AI Outputs, including any warranty that they will be accurate, complete, current, unbiased, error-free, fit for a particular decision, or capable of achieving any particular learning, compliance, behavioural, employment or business outcome.

10.3 The Customer acknowledges that AI features are probabilistic and may generate inaccurate or incomplete results, that the Customer remains responsible for evaluating the suitability, accuracy and legal or regulatory implications of any AI Output before relying on it, and that AI Outputs do not constitute professional advice of any kind.

10.4 Nothing in this clause 10 excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot be excluded, restricted or modified under Applicable Law. Where such a right or guarantee applies and cannot be excluded, Go1's liability is limited, to the extent permitted by law, to resupplying the affected Services.

10.5 The exclusions and limitations of liability in the Existing Agreement apply to Immersive Simulations, AI Outputs and Simulation Data. Nothing in these Go1 Immersive Simulations Product Terms extends Go1's liability beyond the liability expressly accepted under the Existing Agreement.

11\. Suspension and termination

11.1 Go1 may suspend or restrict access to the Immersive Simulations Product where reasonably necessary to prevent harm, address misuse, comply with law, respond to a Third-Party AI Provider restriction, protect security or integrity, or manage a material operational risk. Go1 will give the Customer notice as soon as reasonably practicable and will restore access once the cause has been resolved.

11.2 On expiry or termination of the Customer's right to use the Immersive Simulations Product, the Customer and its Users must cease using it. Simulation Data will be handled in accordance with the Existing Agreement and the applicable retention settings.

12\. Order of precedence and amendment

12.1 If there is an inconsistency between these Go1 Immersive Simulations Product Terms and the Existing Agreement, these Go1 Immersive Simulations Product Terms prevail to the extent of the inconsistency, and only in relation to the Immersive Simulations Product.

12.2 An Order Form varies these Go1 Immersive Simulations Product Terms only where it expressly identifies the clause being varied.

12.3 Updates. Go1 may amend these Go1 Immersive Simulations Product Terms from time to time by publishing an updated version at the URL at which these Go1 Immersive Simulations Product Terms are made available. The Customer's continued use of the Immersive Simulations Product after an amendment takes effect constitutes acceptance of the amended Go1 Immersive Simulations Product Terms.

13\. Survival

13.1 Clauses 1 (Definitions), 2 (Nature and limitations of Immersive Simulations), 3.4 to 3.8, 4.3, 5 (Data, privacy and sensitive information), 6.3, 7 (Customer Content and intellectual property), 8 (Product improvement and model training), 10 (Disclaimers and allocation of risk), 11.2, 12 (Order of precedence and amendment) and this clause 13 survive expiry or termination of these Go1 Immersive Simulations Product Terms, the Customer's right to use the Immersive Simulations Product, or the Existing Agreement.

13.2 Any other provision that by its nature is intended to survive, including any accrued right, remedy or liability of either party, survives expiry or termination.
